Terms of Service

These Terms of Service govern the use of www.scarletbell.com.au (“the website”) including the Student Portal and the purchase of any goods or services from it, as well as subsequent engagement with those services. These terms of Service (Terms) are entered into between Scarlet Bell ABN 96 823 465 761 (we, us or our) and you, together the Parties and each a Party. We provide burlesque and other classes at various studios (Services). In these Terms, you or Student means the person or entity who is registered, or will register, for our Services.

Acceptance  

You accept these Terms by clicking “I accept” or making payment of any part of the fees for the Services you have selected.

Disclaimer / Liability

Your participation in the Services may expose you to the risk of physical harm or personal injury. The risk of physical harm or personal injury may arise from, but is not limited to, third party participants, your fitness level or the equipment used by you. You agree that physical harm or personal injury may arise from you or another party’s acts, omissions or negligence. You understand and voluntarily accept any risk that may arise from your participation in the Services and our classes. You agree that it is your responsibility to only select classes which are suitable for your fitness level and experience. We limit our liability as permitted under the Australian Consumer Law. 

Neither we nor our personnel are medical practitioners and we do not give medical advice, treatment or diagnoses. Our Services are intended to assist you to achieve your fitness goals and/or learn new skills, or improve existing skills. You acknowledge and agree that nothing in the Services we provide may be taken to be medical advice, treatment or a diagnosis by us or our personnel, nor are they intended to be a substitute for consulting a medical practitioner for your particular circumstances and needs. We encourage you to seek appropriate medical advice before using our Services. If for any reason you feel any pain or discomfort during the classes, it is your responsibility to immediately stop participating and inform us immediately, and seek appropriate medical attention. 

Services

Scarlet Bell Burlesque offers and holds Burlesque and other dance / performance classes for adults over the age of 18. Our performance class terms run for 7 weeks with classes that are 45 - 60 minutes in length totalling a minimum of 315 minutes of class time per class per term. Scarlet Bell also offers ‘workshop’ classes outside of these terms, the length of these workshops may vary and are advertised with the workshop.
All students MUST be 18 years old to perform in our showcases, we may allow someone under the age of 18 to take a class as long as they turn 18 ON or BEFORE the date of the showcase.
The first week of any term may be taken as a free trial week for any Beginner or Intermediate class as long as the class does not sell out prior. After this week if you wish to continue you must enrol and make full payment for the whole term. Student Portal, Payments & Payment Options

Students are responsible for ensuring their portal information, including their contact, emergency contact and medical information is up to date at all times.
Payment in full is due at time of enrolment to confirm your place in a class unless a payment plan has been requested. Current pricing is reflected on each class via the student portal enrolment page. Your class fee includes instruction for the time and class type outlined at enrolment.
If you have a discount code please enter this at checkout. We are unable to apply these to finalised accounts/payments.
We do offer payment plans, payment plans require a minimum of 2 classes enrolment and have a $5 per class administration fee on top of your class enrolment prices. For more details on how to set up the payment plan click here.

Cancelation / Refund policy

If you have enrolled and are subsequently unable to attend your course, you may cancel your enrolment for a class credit up to 7 days prior to the start of your course by contacting Scarlet Bell Burlesque in writing. Any less than 7 days prior to the start of your course you may transfer the enrolment to another student or transfer into another course of equal or lesser value (with no refund due) within the same term (pending availability).
Except as otherwise required by the Australian Consumer Law, Scarlet Bell will not provide refunds for services or class payments under any circumstances including change of mind or failure to attend for personal or medical reasons. Scarlet Bell is not responsible for any lateness, incomplete attendance or failure to finish the class.

We require a minimum number of students for classes to proceed and reserve the right to cancel any class that does not meet the required minimum. In the event of a course cancellation due to low registrations, students will be offered the option of a refund or transfer to another class (of equal value or the difference would be payable).

Missed Classes / Illness

If a student is going to miss a class they are required to let their teacher know BEFORE their class time and it is the responsibility of that student to catch up on what has been missed. If a student is unwell with a communicable illness (including symptoms of COVID 19) they are to NOT attend class.
In the instance of a teacher being unable to teach a class due to illness or other circumstance, we reserve the right to use a substitute teacher for that class. If this is not an option, then we will arrange for a ‘make up’ class to be held as a replacement. This class is unlikely to be at the same day and time as your regular class and may even be offered at another location.
Where a Scarlet Bell class falls on a public holiday, Scarlet Bell and it’s teachers will either take this into account when planning to ensure all 7 weeks of the term are offered or where this is not possible provide the class either in person or online at the regular date/time. This also may not be at the same location as your regular classes.

Punctuality / Attendance

Please aim to arrive 5 minutes before your class time so that you are ready for start time. Do not enter the room until your teacher invites you in. Students who are more then 25 minutes late to their class are still able to join in however they will be marked absent on the roll.

Personal Belongings

We accept no responsibility for your personal items and exclude liability for and personal items that are misplaced, lost or stolen both in class and at shows. Please take care of your belongings and ensure you have everything with you when leaving.

Student Showcase Performances

The end of term student showcase performances are non compulsory however the term classes are structured towards a routine to be performed at the showcase. If you do not plan to perform you must let your teacher know by week 3.
Performing in the showcase is also NOT a given as part of your class fee and so if for whatever reason the showcase is cancelled there would be no refund given on classes.
Students who wish to perform at the student showcase are responsible for their own costuming as well as their own hair and makeup on the performance night. Students wishing to perform must have attended a minimum of 5 out of 7 classes in the term and all students who do not meet this requirement may only perform at the discretion and approval of their instructor.
For students performing in the showcase, costume requirements will be outlined by teachers in week 1 of all classes and made available to you in a digital format for reference. Occasionally teachers may require that students order their costumes through The Scarlet Showpony by Scarlet Bell Burlesque store, where a suitable and cost-effective option has been found. These purchases must be made by the deadline given to ensure they arrive in time. Once these costumes have been ordered they will be non-refundable or transferable unless required by Australian Consumer Law.

Photography / Videography

Photography and videography for personal use may be taken at Scarlet Bell Burlesque, however all students must gain approval from all other persons in the footage before publishing it in any format. Students and teachers are not to be filmed or photographed without their knowledge and consent, even in the background. Absolutely NO video footage of the routine/choreography in class environments should be published online, including social media, without the consent of Scarlet Bell Burlesque/Elle Entice and the teacher.
Scarlet Bell Burlesque may employ the services of photographers and videographers at any show. Scarlet Bell Burlesque reserves the right to use and distribute any photo or video footage from shows, including on social media and our website.
Show photos will be made available for your personal use and publication as long as you have permission from everyone in the photo. You must credit Scarlet Bell Burlesque and the photographer/videographer in any/all publications. All content posted or provided by Scarlet Bell Burlesque may not be used to promote your involvement in any shows other than those produced by Scarlet Bell Burlesque.
The service of any photographer/videographer for any show is bound to Scarlet Bell Burlesque.  Photographers and Videographers should not be approached directly for video or photo content from any show. 
Scarlet Bell Burlesque expressly forbids family, friends, photographers or videographers of any kind that are not engaged under agreement with Scarlet Bell Burlesque to photograph or video any show, part of show, or performance.  Under this term, no performer is permitted to employ a photographer or videographer of any kind for any part of a show that is produced by Scarlet Bell Burlesque.  

Copyright

Scarlet Bell Burlesque retain copyright and related rights over all class content and choreography. Class choreography is not to be used outside of Scarlet Bell Burlesque for private, public or commercial use without express written consent by Scarlet Bell Burlesque and the teacher of that class.

Code of Conduct

Scarlet Bell Burlesque is committed to providing an enjoyable experience for all its students, and fostering a Family of support and inclusion. We will not tolerate any of the following:

  • Rude behaviour or conduct towards our teachers

  • Verbal or written abuse of teachers, students or the public, including on social media

  • Any kind of discrimination or hate speech

  • Bullying of any kind, including (but not limited to) rumours, gossip, slander, and cyber

  • Physical abuse or assault towards any other member of the Scarlet Bell Family

  • Any and all perceptions of above to any person

Should this code be broken, you may be asked to leave the studio immediately.
We support the rights of any person to seek legal advice and/or action should they be targeted, exposed to, or affected by the actions of any other person while undertaking classes at Scarlet Bell Burlesque, and we will comply willingly with any legal direction.

Termination

If Scarlet Bell or any of its staff find that you are in breach of any terms laid out in this terms of service we reserve the right to terminate your enrolment with us effective immediately. In the event of such termination Scarlet Bell Burlesque reserves the right to hold any monies already paid and, where needed, seek further remuneration or compensation for damages or other such matters that may occur.


Australian Consumer Law 

WARNING UNDER THE AUSTRALIAN CONSUMER LAW (Cth) 

Under the Australian Consumer Law (Cth), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier is required to ensure that the recreational services it supplies to you: 

  1. are rendered with due care and skill; and 

  2. are reasonably fit for any purpose which you, either expressly or by implication, make known to the supplier; and 

  3. might reasonably be expected to achieve any result you have made known to the supplier. 

By participating in the Services and any classes, you agree to accept, to the extent permitted by law: 

  1. that the supplier can ask you to limit these guarantees; and 

  2. you agree to exclude any responsibility or legal liability of the supplier to you for death or personal injury from the supplier’s failure to comply with these guarantees. 

NOTE: This exclusion does not apply to significant personal injury caused by reckless conduct by the supplier. 

By participating in the Services or any classes, you agree to release the supplier and any affiliates and all parties associated with organising the Services and/or the classes from any responsibility or legal liability for death or personal injury associated with your participation in the Services and/or the classes. This release does not apply to significant personal injury caused by reckless conduct by the supplier. 

In this clause, “supplier” means us and this clause will survive the termination or expiry of these Terms.
